§ 13-5-601. Authority to impose; liability; lien.

  • (a) Authority to impose. Except in the Mayo Reclamation Subdistrict, the County may impose front foot assessments to recover the cost to the County of constructing water and wastewater facilities and of bringing private water and wastewater facilities up to County standards such that the private facilities can become owned by the County.
    (b) Duty to pay. The owners of real property, including the County, who connect the water or wastewater facilities of the property with the water or wastewater facilities of the County or whose property is benefited by the water or wastewater facilities of the County shall pay the applicable front foot assessments.
    (c) Collection. Front foot assessments shall be paid within 30 days of the due date on the billing invoice, and any amount unpaid 30 days after the due date shall be collected as provided in § 1-8-101 of this Code.
