§ 5-3-101. Definitions.

  • In this title, the following words have the meanings indicated.
    (1) "Appointed official" means a County official or employee who serves in a position listed in the exempt pay and benefit plan.
    (2) "Elected official" means the County Executive; the members of the County council; and the State's Attorney for Anne Arundel County.
    (3) (i) "Tier one employee" means:
    1. except for an employee who makes an election to be a tier two employee under § 5-3-203, an employee hired before December 4, 1996;
    2. an employee hired on or after December 4, 1996 who makes an election to be a tier one employee under § 5-3-201; and
    3. an employee who makes an election to be a tier one employee under § 5-3-204.
    (ii) "Tier one employee" includes an employee who has been laid off and reemployed under the provisions of § 6-1-109 of this Code who did not receive a refund of participant contributions prior to reemployment and who makes an election to be a tier one employee at the time of reemployment under § 5-3-202.
    (4) (i) "Tier two employee" means an employee:
    1. hired on or after December 4, 1996 who does not make an election to be a tier one employee under § 5-3-201; or
    2. hired before December 4, 1996 who makes an election to be a tier two employee under § 5-3-203.
    (ii) "Tier two employee" includes an employee who has been laid off and reemployed under the provisions of § 6-1-109 of this Code who did not receive a refund of participant contributions prior to reemployment and who does not make an election to be a tier one employee at the time of reemployment under § 5-3-202.
