§ 8-3-204. Method of sale.

  • (a) Generally. Real property that is surplus and real property that is to be disposed of for purposes consistent with those for which it was originally acquired shall be sold:
    (1) to the highest bidder at public auction;
    (2) in the discretion of the County Executive, to the highest responsible bidder who submits a bid in response to an invitation to purchase the property; or
    (3) through a licensed real estate broker, with the brokerage contract to be awarded in accordance with § 8-2-109.
    (b) Notice and invitation to bid to adjacent owners and community association. Notice shall be given to each adjacent property owner and to the community association representing the area in which the property is located of the method of sale that will be used to dispose of the surplus property and an invitation to bid or purchase.
    (c) Terms and conditions. The County Executive shall establish terms and conditions for a sale under this section as to be in the public interest. The County Executive shall require as a condition of sale that the expenses associated with the sale and conveyance of the property be paid by the purchaser.
    (d) Advertisement. Notice of a public auction or an invitation to purchase property shall be advertised at least once a week for three successive weeks in one or more newspapers of general circulation published in the County. Notice shall also be mailed to each adjacent property owner and to the community association representing the area in which the property is located. The advertisement and notice shall state the location and description of the property and the terms and conditions of the sale, including the minimum acceptable price for the property.
    (e) Refusal to sell. The County Executive may refuse to sell a parcel of real property at the price and on the terms and conditions offered or bid as the County Executive determines to be most beneficial to the County.
    (f) When approval by ordinance required. Approval by ordinance of the County Council is required for the sale of property for which the purchase price is less than 90% of its appraised value or appraised at $50,000 or more.
    (g) Private disposition. Notwithstanding any other provision of this title, if the County Executive determines that the public interest will be furthered by a private disposition of property, the County Executive may negotiate for a private disposition. Before the execution by the County Executive of a contract or agreement for private disposition, the terms and conditions of the disposition shall be approved by ordinance of the County Council.
